Astghik Terms of Use

Welcome to Astghik

By accessing or using Astghik, you agree to be bound by these Terms of Use.

These Terms govern your use of the Astghik platform and apply to all visitors, users, creators, and other participants who interact with our services. References to “Astghik,” “we,” “our,” or “us” mean Astghik, Inc. and all associated products and services, including our websites, applications, APIs, creator resources, embedded features, and related online services.

Your use of Astghik is also governed by our Privacy Policy, Cookie Policy, Community Guidelines, and any additional policies published on the platform, which are incorporated into these Terms by reference.

Please read these Terms carefully before using Astghik. If you do not agree with these Terms or any related policies, you should not access or use the platform. By continuing to use Astghik, you consent to the collection, use, and processing of information as described in our Privacy Policy and Cookie Policy.

Eligibility and Your Account

Summary: You must be at least 18 years old to use Astghik. You are responsible for the security and activity of your account.

Astghik is strictly for adults. By creating an account or accessing our services in any way, you confirm that you are 18 years of age or older. We do not permit individuals under 18 to access, browse, or otherwise use Astghik.

When you register, you must provide accurate information and keep it up to date. You are responsible for all actions taken through your account, maintaining its security, and immediately notifying us at creators@astghik.io if you believe your account has been compromised. Prohibited and Abusive Conduct

Summary: Use Astghik responsibly. Misuse of the platform can result in account suspension or removal.

You are accountable for your actions on Astghik. Violating these Terms or any of our policies may result in your account being restricted or permanently removed. Prohibited activities include:

Breaking any laws or encouraging illegal activity.
Harassing, threatening, or abusing others.
Exploiting Astghik for purposes it was not designed for (e.g., storing unrelated data or files).
Engaging in technical abuse that disrupts platform functionality.

If you are a creator earning income through Astghik, we may also review your conduct off-platform if it poses a risk to the community or to us. The Community Guidelines and Security Policy provide more details on restricted activities.

We reserve the right to take action against any harmful activity, even if it is not explicitly listed in our policies, to protect the safety and integrity of the platform.

Being a Creator

Summary: Creators can use Astghik to share their work, offer memberships, and earn support from clients — but must follow all platform rules.

A “creator” is anyone who sets up a page on Astghik to share content or experiences with paying supporters (“clients”). Creators may offer memberships or one-time purchases, giving clients special benefits such as exclusive content, community engagement, or merchandise. In return, creators receive financial support and the ability to build direct relationships with their audience.

To become a creator, you must launch your Astghik page. We provide tools to help you showcase your work, interact with your audience, and manage your offerings. Memberships are designed for your most dedicated clients, giving them special access and rewards in exchange for ongoing support.

Payments to Creators

Creators can offer one-time purchases or recurring memberships. If supported, prices may be automatically converted into a client’s local currency based on rates determined at our discretion. In certain cases, we may adjust offering prices to reflect fees charged by third-party platforms (e.g., mobile app stores).

We generally manage payment processing, including handling fraud, chargebacks, and disputes. However, for purchases made through third-party platforms, that platform’s rules and timelines may apply. Funds earned will typically be made available according to the service tier you’ve selected, though delays may occur for reasons such as compliance checks, fraud prevention, or policy violations.

If you are an Adult/18+ creator sharing explicit content, you must:

Confirm you are over 18 through our verification process.
Verify all individuals featured in your content are over 18.
Verify that all content you upload does not depict real individuals (anime, animation, 3d artwork etc are accepted. AI art that is indistinguishable from a real person will be rejected)

We may block or withhold payments if we suspect violations of these Terms or applicable laws, or to fulfill tax obligations. Chargebacks, refunds, and platform fees may result in a negative account balance, which we may recover from future payouts.

Tax Information for Creators

Our service is a U.S.-based company and is required to collect certain tax forms from creators who receive payouts through our platform.

• U.S. creators must submit a W-9 form.
• Non-U.S. creators must submit a W-8BEN or W-8BEN-E form.

These forms allow us to determine your tax status and whether any U.S. tax withholding applies.

Withholding for Non-U.S. Creators

Generally, our service does not withhold U.S. tax from payments to non-U.S. creators.

Under U.S. tax rules, taxes are only withheld when a foreign creator earns U.S.-sourced income.
For most creators, your content and services are performed outside the United States, which makes your earnings foreign-sourced. Foreign-sourced income paid to non-U.S. persons is not subject to U.S. withholding.

However, withholding may apply if:

You perform services while physically present in the United States, or
Your tax documentation is missing or incomplete.

If withholding is required, the rate will be determined based on your tax form and any applicable tax treaty.

Your Responsibility

Creators are responsible for following all tax laws in their home country. We does not provide tax advice, but we provide annual earnings information to help you meet your obligations.

Fees

Astghik charges fees for services provided to creators. These may include:

Platform fee: A flat rate and/or percentage of processed payments.
Feature-specific fees: Charges for using certain tools or services.
Payment processing fee: A percentage plus a fixed amount per transaction to cover billing, fraud prevention, and declined payment recovery.
Payout fee: A charge for transferring your funds to your chosen payout method.
Currency conversion fee: A percentage applied when converting currencies for payouts.
Tax fee: We collect VAT and sales tax on all orders when required by law.

If purchases are made through third-party platforms (e.g., app stores), additional fees from those platforms may apply. Full details are available in your creator dashboard, though some fees (like payout fees) may be listed separately.

Taxes

We comply with tax laws in all applicable jurisdictions. This may include collecting your tax information, reporting earnings, and issuing forms such as IRS Form 1099-K for U.S. creators who earn above the reporting threshold. You are responsible for reporting and paying any income taxes owed.

We may also collect and remit transactional taxes (e.g., VAT, GST, U.S. state sales tax) on client payments. The amount collected is based on the benefits you offer and the categories you assign to them, so you must provide accurate descriptions and categorizations.

Transaction taxes will be deducted automatically from client payments and remitted to the appropriate tax authorities. Records of these taxes will be available in your earnings details.

Restrictions

Creators may not offer content or benefits that violate these Terms, our Community Guidelines, or any other Astghik policy. Examples of prohibited offerings include:

Illegal content or activities.
Harassment, hate speech, or abusive material.
Misleading or deceptive claims.
Use of intellectual property without permission or legal right.
Depictions of real people engaged in sexual acts without consent.

If your audience includes anyone under 18, you must clearly remind them they cannot access Astghik or purchase your offerings.

Creators are also responsible for protecting client data and must comply with our Data Processing Agreement (“Creator Privacy Promise”). Accounts are tied to the original creator and may not be sold or transferred.

Astghik may experiment with features that are not available to all creators. Access to these experimental features is at our discretion and may be limited or withdrawn without notice.

Being a Client

Summary: Clients are adults who purchase memberships or offerings from creators on Astghik in exchange for benefits. All purchases are done directly through us as the merchant of record. Your business relationship for tax purposes is always with Astghik.

A “client” is any individual who buys a membership or one-time offering from a creator on Astghik. By doing so, you are supporting that creator’s work and may receive exclusive perks such as private content, special access, shoutouts, or merchandise.

All clients must be 18 years of age or older. By purchasing a membership or offering, you confirm that you meet this age requirement.

Client purchases can be one-time or automatically renewing subscriptions. Astghik is the billing entity for these charges. If your primary payment method fails, we may attempt to charge any backup methods you’ve set up.

The timing, frequency, and amount of charges depend on the type of subscription or offering you choose. You can review the details before purchase and track your active subscriptions in your account.

Purchasing a membership or offering gives you a non-exclusive, non-transferable, revocable, limited license to access the included content for your own personal, non-commercial use. Access to this content may end if your subscription is canceled, your payment fails, or the creator or Astghik removes the content.

Subscription Types

Astghik supports three main types of paid subscriptions:

Monthly: Billed once per month.
Per-Creation: Billed each time a creator publishes eligible content, with an option to set a monthly limit.
Annual: Billed once per year, typically at a discounted rate.

Not all creators offer every type of subscription. The available options will be shown before you commit to a purchase.

Subscriptions automatically renew unless you cancel in your membership settings. If your plan includes a free trial, you will be charged when the trial ends unless you cancel beforehand.

Creators may adjust membership prices with notice, and Astghik may update currency conversion rates for clients paying in a different currency than the creator’s set currency. Applicable taxes are added to the purchase price based on your location.

Cancelations and Changes

You can cancel your subscription at any time. Changes take effect at the start of your next billing cycle for monthly and per-creation memberships. For annual memberships, upgrades take effect immediately with a prorated adjustment; however, downgrades are not available until the renewal date.

Canceling or lowering your subscription tier may result in losing access to client-only posts or other benefits. Access may also be revoked if your payment fails, you are blocked by the creator, the creator removes the content, or the creator’s Astghik account is terminated.

Quality and Availability of Offerings

Membership benefits and offerings vary by creator, and Astghik cannot guarantee their quality or availability. We make efforts to screen for fraudulent creator accounts but cannot confirm the identity or accuracy of every claim made by a creator. You can help keep the community safe by reporting suspicious activity.

Taxes on Client Purchases

If required by law, Astghik will collect and remit applicable transaction taxes such as VAT, GST, or sales tax. The tax amount will be shown during checkout when possible. Tax is calculated based on your location, so you must keep your location information accurate and up to date.

Foreign Transaction Fees

If you pay in a currency different from your payment method’s currency, your bank or card provider may charge a foreign transaction fee. Astghik does not set or control these fees and does not receive any portion of them.

Experimental Features for Clients

We may offer early access, beta, or test features to a limited group of clients. These features are experimental, may change at any time, and are not guaranteed to remain available.

Refunds

Astghik’s general policy is no refunds. Exceptions may be made at our sole discretion. If you made a purchase through a third-party platform such as the App Store, refund requests must be directed to that platform.

Astghik’s Role

Summary: We review content and accounts to enforce our Terms and policies, and may act if violations occur.

Astghik monitors certain pages, posts, and activities on the platform to ensure compliance with these Terms, our Community Guidelines, and Benefit Guidelines. We also review reports from users about potential violations. Investigations may take time and, when necessary, can include reviewing activity outside the platform — especially when funds earned through Astghik may be used in ways that create legal or safety risks.

Whenever possible, we aim to resolve issues in cooperation with creators and clients so they can continue using Astghik. However, we may terminate accounts if doing so is necessary to protect creators, clients, the company, or the broader community.

Astghik may remove a creator or client from participating in annual memberships without removing them entirely from the platform unless another violation warrants full removal. Removing a creator from annual memberships stops new clients from purchasing annual subscriptions for that creator; removing a client from annual memberships stops them from buying new annual subscriptions for any creator.

If you see possible violations of our guidelines, please report them using our help resources.

As a U.S.-based company with international operations, Astghik must follow applicable trade restrictions and economic sanctions, including those issued by the U.S. Office of Foreign Assets Control (OFAC). This means we cannot process transactions involving certain individuals, countries, or goods as determined by relevant government agencies. See our Sanctions Policy for details.

Account Deletion

Summary: You may delete your account at any time; we may also terminate or suspend accounts at our discretion.

You can permanently delete your account through our Privacy Center.

We may suspend or terminate accounts, cancel memberships, and remove descriptions, posts, offerings, or benefits at our sole discretion. If we close another person’s account, you cannot bring a claim against us, and you agree not to do so. If you attempt such a claim, you will be responsible for covering any related damages, including legal costs.

These Terms remain in effect even if your account is deleted or suspended.

Your Creations

Summary: Creators and clients own their own content, but grant Astghik the licenses needed to operate the platform.

Creators retain full ownership of the works they share on Astghik, and clients retain ownership of anything they post (such as comments or messages). However, by uploading or sharing content on Astghik, you grant us a royalty-free, perpetual, irrevocable, non-exclusive, sublicensable, worldwide license to use, copy, store, translate, transmit, distribute, perform, display, and create derivative works from it, in any format and through any channel now known or developed in the future. This license also extends to your name, username, likeness, or voice if included in the content.

This license allows us to host your work, promote memberships and offerings, and operate community features. You still own your content — we are not purchasing it — and we will not use it in exploitative ways or outside the scope of providing Astghik’s services.

You must have the rights to post any content you share. If your content infringes another person’s intellectual property, we may remove it and take further action if necessary. Astghik responds to proper copyright infringement notices and has a repeat-infringer policy for creators and clients.

Clients may not redistribute or use creators’ works in any way not authorized by the creator, including sharing it with people who did not purchase access through Astghik.

Third-Party Apps and Services

Summary: You can connect Astghik with other apps and services — and revoke that access at any time.

If you connect your Astghik account to third-party websites, apps, or services, you may be asked to grant them access to information about your account or allow them to take actions on your behalf. We will follow your instructions in granting such access. You can revoke this permission at any time in your account settings.

Astghik’s Creations

Summary: Astghik owns its own intellectual property and grants limited rights to use its branding for promotion.

All content and materials we create — including our website text, app interfaces, APIs, logos, designs, and code — are protected by copyright, trademark, patent, and trade secret laws.

We grant creators a limited license to use our trademarks and copyrighted materials to promote their Astghik pages, following our Brand Guidelines. Any other use requires our written permission.

If you provide feedback, suggestions, bug reports, or improvement ideas, you agree that we own those contributions outright and may use them to improve Astghik without obligation to you.

Indemnity

Summary: If your actions cause us legal or financial harm, you agree to cover our costs.

You agree to indemnify and hold harmless Astghik, its affiliates, officers, directors, employees, agents, and service providers from any losses, damages, claims, or expenses (including legal fees) arising from your use of Astghik, your content, or your violation of these Terms or other policies.

If we choose to take exclusive control over the defense of such a claim, you agree to cooperate with us in that defense.

Warranty Disclaimer

Summary: We work hard to keep Astghik running smoothly, but we can’t promise it will always work perfectly.

Astghik is provided “as is” without any warranties, express or implied. This includes, but is not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the platform will always function without interruptions, delays, or errors. These disclaimers apply to Astghik, Inc., its affiliates, officers, directors, employees, agents, and third-party service providers.

Limitation of Liability

Summary: If something goes wrong and you lose money, our financial liability is limited.

To the maximum extent permitted by law, Astghik is not liable for indirect, incidental, consequential, or punitive damages related to your use of, or inability to use, the platform.

Our total liability to you for any claim will not exceed the total amount of money we have earned from your use of Astghik. We are not responsible for losses from unfulfilled offerings, conflicts between you and other users, or breaches of third-party agreements.

Dispute Resolution

Summary: Disputes will be resolved in Wyoming under Wyoming law.

We encourage you to contact us first at creators@astghik.io to try to resolve any issues informally.

If we cannot reach a resolution, any disputes related to these Terms or your use of Astghik will be handled in the state or federal courts located in Wyoming, USA. Both you and Astghik consent to this jurisdiction and venue.

These Terms are governed by the laws of the State of Wyoming, excluding its conflict of law provisions.

Everything Else

Summary: These Terms are the full agreement between you and Astghik.

These Terms, along with our other posted policies, form the complete agreement between you and Astghik. They replace any prior agreements and do not create any partnership, joint venture, employment, or franchise relationship between you and us.

If any part of these Terms is found unenforceable, the rest remains in effect. Failure by either party to enforce a right does not waive the ability to enforce it in the future.

We may update these Terms from time to time.
